The man that owns the lot beside me has a huge over 100 year old mupberry tree that hangs over my house and back yard. It has a creek reunning beside it washing the dirt away from the roots. Tree is going to fall and when it does will destroy my house and anyone in it. Can I leagally make him cut it down and how do I go about doing this if I can? He doesn't live on the property and doesn't rent it. It is a vacant lot.
If it is in danger of imminent damage get a witness (some tree cutter) to look at it and provide you with a statement that it is about to fall and damage your home. If you have more time, it it is not about to fall, you should get a court order allowing you to remove it to protect your home. You will have to file suit.
